Who we are

Sierra Log & Timber, LLC ("Sierra", "we", "us") is a log and timber mill in Chico, California. These terms cover sierralogandtimber.com and its sister sites (gallery.sierralogandtimber.com, resources.sierralogandtimber.com, blog.sierralogandtimber.com and our realtor portal), together "the sites". Our Privacy Policy explains how we handle your information and forms part of these terms.

Eligibility

You must be at least 18 years old to submit a request, sign up for messages or place an order with us. By doing so you confirm that you are.

Using the sites

You may use the sites for lawful purposes only. You agree not to:

• break any applicable law or regulation while using the sites;
• try to gain unauthorised access to the sites, their servers or any connected system;
• use robots, scrapers or other automated means to copy the sites or their data without our written permission;
• introduce viruses or other harmful code, or interfere with the sites working normally;
• impersonate Sierra, our staff or anyone else, or submit information that is not yours to give.

Products and information on the sites

We describe our log and timber packages, plans, parts and shade structures as accurately as we can, but descriptions, specifications, photographs, availability and prices can change without notice. Wood is a natural material: colour, grain, checking and dimensions vary from piece to piece and from what you see on a screen.

Estimates, calculators and INSIGHT are not quotes

Our calculators, the shade structure configurator's budget prices and delivery estimates, the figures on our package and plan pages, and every other estimate on the sites are general information to help you plan. They are not quotes, offers or guarantees of price, quantity, schedule or suitability for your site.

INSIGHT is a market research tool. It is research, not a quote, a certified valuation or a build budget. The figures come from public search results on the day you search, and anything you build from them is hypothetical. It is not financial, lending, legal or construction advice. Take it to your builder, lender and local authorities before you rely on it.

A binding price exists only in a written quote, invoice or agreement from Sierra, for the period that document states.

Quotes, orders and pricing

The $950 Design Package, free study sets, plans packages, log packages, parts, shade structures and every other product or service are governed by the order documents for that purchase: the quote, invoice, order form or agreement you accept. If those documents differ from anything on the sites, the documents control. Any offer shown on the sites, including its price and any end date, applies only as those documents state it.

When you order, you agree to give us current, complete and accurate information. We may refuse or cancel an order, for example where a price was shown in error or we suspect fraud, and we will refund anything you paid for an order we cancel. Purchases made in our floor plan store are also subject to that store's own policies.

Text messaging (SMS) terms

By giving us your mobile number and opting in to text messages from Sierra Log & Timber, you agree to the following:

• Program description: after you opt in, you will receive texts about your inquiries, orders, appointments and customer service and, where you have agreed, offers and updates about our products and services.
• Message frequency varies with your interactions with us.
• Message and data rates may apply. Charges are billed by and payable to your mobile carrier.
• Opt out at any time by replying STOP to any message from us, including messages from +1 530 670 0872. We will send one final message to confirm, and then no more. To rejoin, opt in again.
• Reply HELP for help, or contact us at info@sierralogandtimber.com or (530) 899-0680.
• Carriers are not liable for delayed or undelivered messages.
• Privacy: no mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Our Privacy Policy explains how we handle your information.
• Consent to receive texts is not a condition of buying any goods or services from us.

Intellectual property

Smart Cut™ is a trademark of Sierra Log & Timber. The Sierra Log & Timber name, INSIGHT and our logos are also ours, and you may not use them in a way that suggests we endorse you or your product.

The floor plans, drawings, study sets, panel drawings, cut lists, photographs, text and software on the sites are owned by Sierra or its licensors and are protected by United States and international copyright law. You may view and print them for your own personal, non-commercial planning. You may not copy, alter, republish or sell them, or use any plan or drawing to build, without our written permission or the licence given in your order documents.

What you send us

When you send us information through a form, the chat, the realtor portal or by text, you confirm it is accurate and that you have the right to share it. Ideas and feedback you volunteer may be used by us without any obligation to you.

Third-party sites and services

The sites link to and use services run by others, such as public agencies, map providers, our store platform and the chat and booking tools. We do not control them and are not responsible for their content or practices. Names of other companies mentioned on the sites are trademarks of their owners, and a mention is not an endorsement or partnership.

Disclaimer of warranties

The sites and their content are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not promise that the sites will be uninterrupted, error free or free of harmful components. Warranties for products you buy are only those stated in your order documents.

Limitation of liability

To the fullest extent the law allows, Sierra and its owners, employees and agents are not liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, data, project costs or delays, arising from your use of, or inability to use, the sites or anything on them, even if we were told such damages were possible.

Our total liability for any claim arising from the sites is limited to the amount you paid us for the item giving rise to the claim in the 12 months before it arose, or $100 if you paid nothing. Some places do not allow these limits, so they may not all apply to you. Nothing here limits our obligations under your order documents or any liability the law does not allow us to limit.

Indemnification

You agree to defend, indemnify and hold harmless Sierra and its owners, employees, contractors and agents from claims, losses and costs, including reasonable attorneys' fees, arising from your breach of these terms or your misuse of the sites.

Governing law

These terms, and any dispute arising from them or from the sites, are governed by the laws of the State of California, without regard to its conflict of law rules. Any legal action must be brought in the state or federal courts located in California, and you consent to their jurisdiction.

Changes and general terms

We may change these terms at any time by posting a new version here and updating the "Last updated" date. Your continued use of the sites after a change means you accept it. If any part of these terms is found unenforceable, the rest remains in effect. Our failure to enforce a term is not a waiver of it.
